What happened?
On February 3, 2025, the California Civil Rights Department (CRD) released updated guidance for the 2024 pay data reporting cycle, due May 14, 2025.
Overview:
The CRD made an update to the California Pay Data Reporting for 2025, which includes:
Changes to Race/Ethnicity Categories
- New Category: “Middle Eastern or North African” (MENA) has been added.
- Updated Categories: “Two or More Races” is now “Multiracial and/or Multiethnic,” and “Native Hawaiian or Other Pacific Islander” is now “Native Hawaiian or Pacific Islander.”
New Resources
- Handbook: The CRD has issued a comprehensive 23-page handbook with detailed instructions on reporting requirements and filing processes.
- Updated Instructions: Separate 10-page documents now provide step-by-step guidance for completing the reporting templates.
Additional Details:
- Who Must Report: Private employers with 100 or more employees, including those hired through labor contractors, must submit annual pay data reports.
- These reports include employee pay, demographics, and other workforce data, such as mean and median hourly wages broken down by race, ethnicity, and gender for each job category.
- Penalties: Non-compliance can result in penalties of up to $100 per employee for the first offense and $200 per employee for subsequent violations.
- Identify Reporting Period: Select a single pay period during the previous fourth quarter (Oct. 1-Dec. 31) to collect data.
- Gather Detailed Pay Data: Collect information on mean and median hourly rates and the total hours worked for each employee.
- Submit Reports to CRD: Ensure all collected data is accurately reported and submitted by May 14, 2025.
