On February 9, 2026, the U.S. Department of Labor (DOL) announced updated minimum wage rates for certain federal contracts covered by Executive Order 13658.
Effective May 11, 2026, the minimum wage increased to $13.65 per hour for non-tipped employees and $9.55 per hour for tipped employees on covered legacy federal contracts.
This update applies to certain federal contracts entered into between January 1, 2015, and January 29, 2022, that were not renewed or extended on or after January 30, 2022.
What Employers Need to Do
- Review whether any covered legacy federal contracts remain active after May 11, 2026.
- If so, update pay rates to at least $13.65 per hour or $9.55 per hour for tipped employees and ensure the applicable federal contractor notice is posted.
